Appeal Filed to State Supreme Court in Bethune Case

Carbondale – The special prosecutor in the Gaege Bethune/Pravin Varughese case is filing an appeal to the state Supreme Court. Special Prosecutor David Robinson has filed for a motion to appeal, feeling that the judge used the wrong legal standard in overturning the jury’s guilty verdict. Bethune had been found guilty of first degree murder in the death of SIU student Pravin Varughese, but Judge Mark Clarke overturned the verdict due to what he called potentially confusing language in the indictment. The Court has yet to accept the filing.
